European Nature Conservation Legislation and its implementation in Germany

The European Community created an ambitious nature conservation legislation with its "Directive on the Conservation of Natural Habitats and of Wild Fauna and Flora" and the "Wild Birds Directive", the extent and consequences of which have become more and more apparent in Germany and other member states over the last years. Sentences by the European Court of Justice concerning insufficient legal transposition and effective implementation required the EU member states to rethink their environmental policies and acts, and also called for an amendment of the Federal Nature Conservation Act in Germany which the Department of Environmental and Planning Law accompanied critically. All this stimulated the efforts of habitat protection, which progress further through the establishment of the coherent European network of nature protection areas "Natura 2000". After phases I (site identification) and II (site selection) have largely been completed, Germany now has to turn these sites into sites protected by law until 2010 (phase III). Considering this background the Department of Environmental and Planning Law deals with the current situation of implementation in Germany and other selected EU member states, and discusses current legal questions. Among these are the legal demands on protection as well as questions on interpretation and questions of procedure concerning the impact assessment of the Habitats Directive. Though it had been underestimated in the beginning, species protection outside of conservation areas nowadays takes a special position in authorisation procedures, court decisions, and in expert discussions. Furthermore, the extent of prohibitory provisions, the exemptions in nature conservation legislation concerning certain forms of land use, and the determination of the form of exemption rules are part of the Department's research.
