Abstract Environmental constitutionalism has grown significantly in recent years in many countries and also at regional and global level. This was due to spectacular court decisions at various levels on the issue of climate protection. In Germany, the BVerfG decision of 24 March 2021 was such a „game changer“ because the recognition of a right to intertemporal protection of freedom has supplemented the traditional duty to protect approach and significantly increased the court's ability to determine constitutional violations of the environmental protection directive of Article 20a of the Basic Law. Subject of this paper is the question, whether the new fundamental rights approach is also transferable to other environmental problems, in particular to the field of action of biodiversity protection.
