| Abstract | This paper proposes adjustments of applicable civil and public law in order to strengthen sustainable consurnption. The legal analysis is complemented by law and economics considerations of legal consequences and effects with respect to resource conservation through extension of lifespan of consumer goods. Sustainable consumption, especially the challenge of (planned) obsolescence of products, can be considered from different fields of law. So far, these provisions in environmental law and in consurner law are to a great extent not linked to each other. Moreover, they are not sufficient to provide effective and efficient sustainability in consurnption. Main focus of the paper is to adjust civillaw, especially defects of liability law, competition law and guarantee law. Information duties should be addressed to producers and traders as well. Specifically a mixture of instruments (public and civillaw) is required. Therefore, the paper assesses instruments that constitute entitlements as weil as instruments concerning the enforcement of those entitlements based on collective enforcement by NGO's acting in consumer and environmental protection. Thus, the article aims at contributing to link the different fields of law based on institutional economics considerations in order to strengthen sustainable consumption. |
