| Abstract | With the so-called Governance Regulation of 2018 and the Climate Law of 2021, the EU has created a comprehensive target and planning system for the climate policy of the Member States in order to put the Union on the path to climate neutrality and keep it there. The contribution provides an overview of this new type of “policy planning law” and discusses key implementation issues using Germany as an example. It is submitted that policy planning law is a necessary institutional prerequisite for the transformation of the EU and its member states to climate neutrality and that it can only fulfill its necessary contributions to the transformation if it is effectively extended by the member states to the subnational levels. Further, it is considered whether functional policy planning law is also required by fundamental rights as an indispensable means of governance to protect life, health, and freedom. |
